INCREASED COST OF IMPROVEMENTS
NOTICE IS HEREBY GIVEN that the Town Board of the Town of Elizabethtown, Essex County, New York, did duly adopt on April 15, 2025 an Order Calling a Public Hearing on the question of an increase in the cost of the establishment of the Sewer District No. 1 in the Town in the amount of $27,550,000 to a revised maximum estimated cost of $37,100,000. The material elements of said Order and the details of said public hearing are summarized below.

In the Matter Of a Proposed Increase (Pursuant to Section 209‑h of the Town Law) in the Maximum Amount Authorized to be Expended in Connection with the Establishment of Sewer District No. 1 in the Town of Elizabethtown, Essex County, New York |
The capital improvements hereinafter described have been determined to be a Type I Action pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act, the implementation of which as proposed, the Town Board has determined will not result in any significant adverse environmental impact, which determination hereby remains in effect in connection herewith.
The improvements to be made as heretofore provided are the construction of a sanitary sewer system and wastewater treatment plant including acquisition of land or rights-in-land, together with original furnishings, equipment, machinery, apparatus, appurtenances, and incidental improvements and expenses in connection therewith, which are the improvements as originally proposed.
After all necessary proceedings were duly had and taken in accordance with the provisions of the Town Law, the Town Board of the Town of Elizabethtown, Essex County, New York, has heretofore duly established Sewer District No. 1 (the “Sewer District “) at a maximum estimated cost of $9,550,000.
It now appears that such maximum estimated cost for the establishment thereof must be increased by an additional $27,550,000 to a new maximum estimated cost of $37,100,000 pursuant to Section 209‑h of the Town Law.
The method of financing the cost of said improvements shall be by the issuance of serial bonds of said Town maturing in annual installments over a period not exceeding forty (40) years, such bonds to be payable from assessments levied upon and collected from the several lots and parcels of land deemed benefitted by said improvements in the manner provided by law, and in an amount sufficient to pay the principal of and interest on said bonds as the same become due, but if not paid from such source, all the taxable real property in said Town shall be subject to the levy of ad valorem taxes without limitation as to rate or amount sufficient to pay the principal of and interest on said bonds as the same shall become due.
The estimated cost of hook-up fees to the typical property in the Sewer District remains $____0.00____ and the estimated cost of the Sewer District to the typical property therein, being a one or two family home, has heretofore been described to be $____362.00____ in the first year in which operation, maintenance, debt service and other charges and expenses are to be paid and it is now anticipated that such estimated cost shall be $___2,864.54_____.
A detailed explanation of the manner by which said costs for the typical property were computed, the amendments to the plan and report for the improvements for the establishment of the Sewer District, as well as all materials completed in compliance with the State Environmental Quality Review Act, have been filed in the office of the Town Clerk where the same are available for inspection during regular office hours.
The properties within the boundaries of said Sewer District remains unchanged and are described within the boundary description attached hereto as Exhibit A and hereby made a part hereof.
A public hearing of the Town Board of the Town of Elizabethtown, Essex County, New York, shall be held at the Town Hall, 7563 Court Street, in Elizabethtown, New York, in said Town, on May 13, 2025, at 6:15 o’clock P.M., Prevailing Time, to consider the question of determining whether the increase in maximum estimated cost described herein is in the public interest, and to hear all persons interested in the subject thereof concerning the same, and for such other action on the part of said Town Board in relation thereto as may be required by law or as may be proper in the premises.

Please join the Town of Elizabethtown Town Board and Suozzo, Doty & Associates for the informational session on March 26, 2025 at 6:00PM. The session will be held at The Essex County Board of Supervisors Chambers, 7551 Court St, Elizabethtown, NY.
At this session, the engineering team will report the water quality testing results in the Water Quality Testing results in the waterways around the hamlet. There will be opportunity for questions or comments from the public regarding the testing and its impact to residents, property owners, and the wastewater project. Please Join Us!
